The Data Protection Officer (DPO) has the responsibility to serve as HEART/NSTA Trust’s independent advisor and monitor for data protection compliance, providing expert guidance on the lawful processing of personal data in accordance with the Data Protection Act, 2020. The DPO will support the Organisation in managing data protection risks, ensuring accountability, promoting awareness, and serving as the point of contact with the Information Commissioner and data subjects.
The DPO is also responsible for conducting the necessary Data Protection Impact Assessments [DPIA] to identify risks arising out of the processing of personal data and to minimise these risks as far and as early as possible.
REQUIRED EDUCATION/EXPERIENCE/EXPERTISE:
- Bachelor’s degree in Law, Computer Science, Information Security, Public Policy, Business Administration or equivalent qualification from recognized tertiary institution
- Certification in data protection or privacy (e.g., CIPP, CIPM, CDPO) strongly preferred
- Experience or specialized training in records and information management systems.
- At least three (3) years of experience in compliance, data governance
KEY COMPETENCIES:
- Demonstrates excellent leadership skills
- Good knowledge of risk management techniques and strategies
- Proficiency in the use of the relevant computer applications
- Knowledge of change management principles and practices
- Expert knowledge of data protection/data privacy legislation and practices (General Data Protection Regulation)
- Strong analytical, advisory, and problem-solving skills
KEY DUTIES:
- Develops, implements, and maintains a comprehensive Data Privacy Governance Framework, strategies, policies, and procedures to manage personal data processing in compliance with the Data Protection Act and relevant regulations
- Establishes and maintains appropriate systems and internal control mechanisms aligned with prescribed data protection standards of the Data Protection Act
- Reviews and updates the Trust's Data Protection policies, procedures, and plans regularly to ensure alignment with changes in laws, regulations, and organisational practices
- Monitors the Trust's adherence to the Data Protection Act, associated regulations, other relevant data protection provisions, and internal policies
- Conducts regular assessments, audits (including collaborating with Internal Audit and other relevant units), and reviews of business processes and workflows to ensure and verify compliance with data protection requirements
- Ensures the timely collection, analysis, and reporting of data on key performance measures related to data protection compliance
- Identifies and highlights the failures or gaps in compliance with applicable data protection rules to relevant management and stakeholders.
- Provides advice on DPIAs when requested, monitor their execution, and advises on mitigating identified risks. Provide guidance on gaps identified through DPIAs to senior leadership
- Informs and advises senior management (MD, Deputy MDs, Directors), data controllers, data processors, and employees of their obligations, rights, and responsibilities under the Data Protection Act and other relevant provisions. Provide interpretation and application guidance
- Serves as the primary internal expert on data protection matters
- Develops relevant training materials and deliver training and sensitization programs for employees on data protection compliance requirements, policies, and best practices
