JOB SPECIFICATION

 

JOB TITLE:                          Legal Advisor

 

DEPARTMENT:                  Executive

 

LOCATION:                         Providenciales

 

 

1.0            JOB SUMMARY

The Legal Advisor is a member of the Commission’s management team.  The officer holder is responsible for advising the Commission, the Managing Director, and the Board of Commissioners on legal matters including, but not limited to, the development and interpretation of legislation, initiating or responding to litigation, taking enforcement actions, and responding to complaints.  The Legal Advisor is also responsible for the regulation of insolvency practitioners, managing cooperation with international partners, coordinating with external counsel and relevant consultants, and providing general policy advice.

 

The Legal Advisor supervises a team and manages the work of the Legal Unit. 

 

The Legal Advisor will be located at the Commission's Providenciales Offices; however, the officer may be required to work from the Commission's Grand Turk office, and to undertake international travels for work or training.

 

 

2.0           EDUCATION & EXPERIENCE

This position requires that the job holder possess at a minimum:

i)               An LLB or Juris Doctor in law or its equivalent

ii)              A Legal Profession Certificate or its equivalent, and

iii)            At least seven years post qualification experience

 

Post Qualification Experience should include:

i)               Drafting of contracts, policies, and memoranda of understanding

ii)              Drafting of legislation and instructions to Government Agencies, consultants and other service providers

iii)            Interpreting commercial and financial services legislation

iv)            Management and supervision of Legal Officer(s) and administrative staff

 

3.0 Required Knowledge and Skills

The Legal Advisor should, at a minimum:

i)               have a sound knowledge of all relevant legislation, regulations, codes, guidelines, and similar directions in effect in the Turks and Caicos Islands;

ii)              be able to interpret and apply complex rules and regulations;

iii)            be able to  utilise  Justis,  Lexis  Nexis,  Thomas  Reuters,  or  another  comparable  legal  research platform;

iv)            be able to prioritise and manage multiple projects and initiatives;

v)              have the highest level of confidentiality and ethical standards;

vi)            be able to  work  independently  and  under  pressure,  to  manage  multiple  concurrent  tasks  and responsibilities, and to deal with changing priorities;

vii)           have excellent research, analytical, writing, and communication  skills;

viii)          be able to work collaboratively with different teams and stakeholders; and

ix)            be familiar with Microsoft Office Suite of products.

7.0           KEY DUTIES & RESPONSIBILITIES

Legal Duties and Responsibilities

  1. Analyse, assess, and review existing financial services legislative and regulatory framework with a view to enhancing the organisation’s capability and making recommendations for improved regulation of the sector.
  2. Advise the Managing Director, Commission and Board on all matters relating to the interpretation of the Financial Services Commission Ordinance and related laws and regulations.
  3. Draft, in association with the Office of the Attorney General, and others where applicable, new and amended legislation, regulations, and other agreements, as required to enhance the protection for clients of financial service providers.
  4. Where external legal counsel is sought, under direction from the Managing Director, instruct such counsel as to the interest of the Financial Services Commission.
  5. Prepare and review contracts of service between the Commission and consultants/service providers.
  6. Monitor the progress of legal action filed by or against the Commission.
  7. Advise the Commission’s guidance and information on developments with respect to legislative policy problems, concerns, and issues arising from the regulated sectors.
  8. Direct civil litigation in relation to investigation and enforcement actions.
  9. Prepare written submissions to ensure that the complete case has been prepared for presentation to the retained Counsel in an acceptable format.
  10. Give evidence in judicial or quasi-judicial proceedings, as necessary.
  11. Assist in the formulation of strategies to raise the level of public awareness of breaches of the various laws and regulations administered by the Commission.
  12. Prepare papers, as required, in relation to enforcement for Board and Board Committee meetings and attend these meetings as directed by the Managing Director.
  13. Keep abreast of developments in financial services regulations worldwide to explore new approaches to improve the capacity of the Commission and provide legal opinions, where required.
  14. Perform other related duties as assigned from time to time.

 

Supervisory Duties and Responsibilities

  1. Lead and guide the work of the Legal Unit in achieving its work program goals and strategic objectives.
  2. Provide leadership and supervisory support to relevant officers.
  3. Develop, monitor, supervise and evaluate the Senior Legal Office(s)
  4. Manage the Unit’s succession plan

 

Administrative Duties and Responsibilities

  1. Provide appropriate, accurate and timely reports on the work of the Legal Unit.
  2. Prepare the annual work program and budget for the Unit.
  3. Coordinate the preparation of the Unit’s contribution to the Commission’s Annual Report.
  4. Conduct performance appraisal for relevant staff.

 

 

8.0           AUTHORITY TO:

i)               Represent the Commission at domestic and international meetings; in Court matter; and in negotiating contracts, within established parameters.

ii)              Access highly confidential and sensitive information related to all aspects of the Commission’s operations.

 

 

9.0           PERFORMANCE CRITERIA:

This job is satisfactorily performed when:

i)               Advice on legal matters reflects sound knowledge of relevant laws and regulations

ii)              Timely and comprehensive recommendations are developed to address identified deficiencies in local laws and regulations

iii)            Legal and Reputational risks are low or have been mitigated.

iv)            Reports are produced within stipulated deadlines

v)              Professional work ethics and integrity are maintained
