DEPUTY GENERAL COUNSEL,

ADVISORY & COMPLIANCE

FIXED TERM CONTRACT

 

 The Financial Services Commission (FSC) is an integrated financial services regulator. Our mission is to regulate and supervise the securities, insurance and private pensions industries,

The FSC has an immediate opening for the position of Deputy General Counsel (Advisory and Compliance).

 

MAJOR ACCOUNTABILITIES:

  • Reporting to the General Counsel, serving as the primary financial legal advisor to the commission and its sector divisions on policy and enforcement issues pertaining to licensees and registrants of the Commission.
  • Oversee the provision of legal advice on regulatory policy issues in relation to licensees and the registrants of the Commission, in relation to AML/CFT/CFP regulations. Providing support as primary legal advisor to the Investigation &Enforcement Division of the Commission.
  • Coordinating and monitoring legal opinions and interpretations, advice on enforcement actions, documentation, representation; interpreting financial regulations and policy; drafting and analysing financial services legislation for persons supervised by the Commission.
  • Providing legal advice on current market conduct obligations placed on licensees and registrant under their governing statutes, as well as the Anti-money laundering (AML), Counter Finance Terrorism (CFT), Counter Proliferation Financing (CPF) obligations of these licensees and registrants and providing appropriate legal support for enforcement actions.
  • Contributing to the formulation of Divisional objectives in accordance with the strategic goals of the Commission.
  • Assisting with coordinating representation on the Commission’s behalf by external counsel in litigious matters pertaining to the Commission’s regulatory functions matters.
  • Reviewing legal opinion, briefs and other documents of legal advice generated by the legal counsels to ensure consistency in application of the law.
  • Contributing to the day-to-day operations of the Legal Services Division, including inter alia, managing the preparation of the Division’s budget.
  • Providing managerial oversight of the work processes and procedures and identifying areas for improvements in efficiency and effectiveness.
  • Providing managerial leadership to the staff of the Legal Division and ensuring the achievement of Divisional objectives through the development of work plans, the allocation of resources and the effective monitoring of employee performance.

 

QUALIFICATIONS AND EXPERIENCE

  • Attorney at Law admitted to practice in the Courts of Jamaica with a minimum of ten (10) years post-qualification experience.
  • At least four (4) years’ experience in a managerial capacity and particular experience or broad exposure to financial regulation, legislative, prudential, supervisory, regulatory, policy and enforcement issues as well as administrative Law.
  • Experience in supervising a legal team would be an asset.
