Deputy General Counsel (Financial Regulations and Administrations).

 

The Financial Services Commission (FSC) is an integrated financial services supervisor/regulator. The FSC has an immediate opening for the position of Deputy General Counsel (Financial Regulations and Administrations).

MAJOR ACCOUNTABILITIES:

  • Reporting to the General Counsel, serving as the primary financial legal advisor to the commission and its sector divisions on legislative matters and matters regarding statutory interpretation, amendments to laws and new laws on issues pertaining to licensees and registrants of the Commission.
  • Coordinating and monitoring the provision of instructions to the Commission’s parent Ministry and collaborate with same regarding any necessary legislative or other amendments; interpreting financial regulations and policy; assist with the drafting and analyzing financial services legislation for persons supervised by the Commission.
  • Providing legal advice on current market conduct obligations placed on licensees and registrant under their governing statutes, as well as the Anti-money laundering (AML), Counter Finance Terrorism (CFT), Counter Proliferation Financing (CPF) obligations of these licensees and registrants and providing appropriate legal support for enforcement actions.
  • Providing legal advice on assuming market conduct obligations for DTI’s and non-DTI’s and guidance on legislative reform required associated with the same.
  • Contributing to the formulation of Divisional objectives in accordance with the strategic goals of the Commission.
  • Draft and review internal policy documents.
  • Reviewing policy papers, draft cabinet submission and other documents relative to the legislative process to facilitate efficiency in so far as he Commission has a role in the legislative process relative to laws, regulations etc relevant to the Commission.
  • Contributing to the day-to-day operations of the Legal Services Division, including inter alia, managing the preparation of the Division’s budget.
  • Providing managerial oversight of the work processes and procedures and identifying areas for improvements in efficiency and effectiveness.
  • Providing managerial leadership to the staff of the Legal Division and ensuring the achievement of Divisional objectives through the development of work plans, the allocation of resources and the effective monitoring of employee performance.

QUALIFICATIONS AND EXPERIENCE

  • Attorney at Law admitted to practice in the Courts of Jamaica with a minimum of ten (10) years post-qualification experience.
  • At least four (4) years’ experience in a managerial capacity and particular experience or broad exposure to financial regulation, legislative, prudential, supervisory, regulatory, policy and enforcement issues as well as administrative Law.
  • Experience in supervising a legal team would be an asset.
  • Experience working with a financial regulator or large institution would be an asset.
