Enforcement and Compliance Officer

Key Responsibility Areas:

  1. Management/Administrative Responsibilities
  • Participates in the development of the Division’s Corporate/Operational Plans, Budget and Individual Work Plans;  
  • Represents Senior Director/Manager at meetings, conferences, workshops and seminars;
  • Prepares reports and project documents as required; 
  • Prepares and delivers Compliance & Enforcement Management presentations as needed;
  • Supports and maintains customer service principles, standards and measurements.
  1. B.  Technical/ Professional Responsibilities
  • Implements and maintains compliance and enforcement plans for assigned parish or areas of a parish detailing short- and long-term priorities by assessing existing or emerging issues and their impact or potential impact on the environment, development planning or the integrity of the regulatory regimes;
  • Maintains and updates the parish register of the NEPA’s compliance and enforcement universe;
  • Identifies, analyses, evaluates and develops of targeted actions to respond to risks through the administration and maintenance of the parish Register concerning Compliance & Enforcement Management;
  • Monitors compliance activities for assigned parish or areas of a parish through the application of variety of tools to gauge compliance with environmental and development planning legislation and other statutory instruments such as approvals, licenses, permits, etc.;
  • Conducts field and desktop assessments for assigned parish or areas of a parish by:
    1. inspecting and analysing GIS (aerial and satellite imagery) to gather information and assess compliance;
    2. scheduling proactive and reactive inspections to address compliance and enforcement priorities, as well as in response to reports of incidents such as pollution of varied types, etc.;
  • Conducts compliance and enforcement field and desktop audits for assigned parish or areas of a parish by:
  1. auditing sites and assessing procedures and processes that are in place to manage environmental and development planning risks;
  2. assessing targeted documents and records provided to or requested by the agency to determine if they meet the statutory requirements;
  3. determining the cause of an incident, for example air quality, water, noise pollution, oil and other toxic spills, etc.
  4. assessing compliance with environmental and development planning legislation such as interfering with endangered species, building without the requisite approvals, operating high risk facilities without the necessary permits/licenses, etc.;
  5. determining what action may be needed to prevent further occurrence or to enforce compliance with environmental and development planning legislation;
  6. determining whether contravention of environmental and development planning legislation has occurred that may warrant prosecution or alternative punitive action;
  7. Follow-up mechanisms;
  8. remedies to fix compliance problems or “make good”;
  9. sanctions to punish, deter and change behaviours;
  • Conducts investigations for a range of reasons, such as:
  • Uses enforcement tools and systems to identify non-compliance environmental and development planning including permits licenses, approvals, etc., by activating:
  • Receives, records and acknowledges all reports from the public concerning environmental and development planning breaches and assesses the risk posed to the environment;
  • Monitors the annual Bird Shooting Exercise by acting Game Warden;
  • Assesses information from other regulators and agencies, such as Water Resources Authority, Municipal Authorities, etc., to detect potential non-compliance and determines the appropriate response in line with NEPA’s compliance and enforcement priorities;
  • Partners with Corporate Communication, Public Education & Customer Service team by educating the public about environmental and development planning breaches and their attendant rights and responsibilities;
  • Maintains compliance and enforcement statistical applications, tools, metrics, measurements and reporting mechanisms to streamline operations and aid decision-making;
  • Uses, updates and maintains compliance and enforcement records and data management systems to aid accuracy, efficiency and accountability;
  • Partners with the Legal Services Division in crafting Service Level Agreements between bought divisions, reflecting a tiered risk-based approach to escalation of matters concerning enforcement in keeping with legislative requirements;
  • Develops submissions for non-routine/complex enforcement matters through regional manager for review by the Legal Services Division, as well as, escalating matters in accordance with Service Level Agreements to aid the preparatory works for enactment of penalties and sanctions to deter non-compliance;
  • Informs the development of guidance and policy materials to inform changes to environmental and development planning legislation based on lessons learnt from compliance and investigations business processes and procedures;
  • Provides expert advice and participates in committees and boards addressing Compliance and Enforcement management matters and provide expert advice to external and internal stakeholders in a professional, consistent and evidence-based manner to maximise appropriate influence;
  • Maintains and ensures effectiveness of Compliance and Enforcement quality management standards, programmes and documentation to assure compliance with policies, regulations and procedures;
  • Maintains key partnerships and cross-government integrated working groups and teams required to align multiple agency interests to realise the objectives set in various GOJ Environmental, Development Planning, Land Use legislation, policies and priorities;

Keeps current with the latest tools/techniques in Compliance and Enforcement Management to determines what new solutions and implementations will meet the GOJ business r

C. Human Resource Responsibilities

  • Contributes to and maintains a system that fosters a culture of teamwork, employee empowerment and commitment to the Division’s and organization’s goals;
  • Assists with the preparation and conducts presentations on role of Division/Unit for the Orientation and Onboarding programme.

Authority

  • The incumbent is authorized to:
  • Issues site warning notices;
  • Escalates to Regional Compliance & Enforcement Manager for approval and dissemination of tier 2 warning notices, letters, etc.;
  • Recommends Compliance and Enforcement Management plans, proposals and systems;
  • Recommends new policy development and/or changes concerning Compliance and Enforcement Management;
  • Monitors programmes and policies concerning Compliance and Enforcement Management.

  • Compliance and enforcement plans Implemented and maintained in accordance with legislative frameworks, established principles and practices, as well as agreed timeframes;

  • Technical advice provided are intelligence-led, evidence-based and timely;

  • Reports, technical papers, and publications are appropriately prepared and submitted within the required timeframes;

Working Conditions

  • Work will be conducted in an office equipped with standard office equipment and specialized software.  The environment is fast paced with on-going interactions with critical stakeholders and meeting tight deadlines which will result in high degrees of pressure, on occasions.
  • Will be required to travel locally for 75% of the time to conduct site visits, investigations, incidents, etc., as well as to attend conferences, seminars and meetings.
  • May be required to work on weekends and public holidays.

 

Required Competencies

  • Knowledge of Compliance and Enforcement Management frameworks;
  • Knowledge of Intelligence-led, evidence and risk-based management approaches to compliance and enforcement management;
  • Knowledge of urban, regional planning and sustainable development quality management approaches and systems;
  • Knowledge of Compliance and Enforcement Management monitoring and evaluation frameworks;
  • Knowledge and expertise in quantitative and qualitative methodologies, reporting, data quality assessments, data analysis and presentation;
  • Good knowledge of the development, analysis, revision and implementation of policies, procedures, guidelines, programmes impacting environmental management and sustainability;
  • Strong ability to synthesize multiple ideas and complex information into a coherent summary, as in reports and briefing notes, and to make cogent recommendation for the modification or creation of legislation, policies and programmes;
  • Superior verbal and written communication skills, with the ability to deliver presentation with tact, clarity, enthusiasm and accuracy to widely varied audiences;
  • A high level of initiative and self-motivation;
  • Demonstrated interpersonal and negotiation skills;
  • Aptitude for developing and maintaining collaborative relations with team members both within and outside the Agency, and for functioning effectively on inter-ministerial and multi-sectoral committees and working groups;
  • Familiarity with procedures, policies and legislation governing the machinery of government;
  • Knowledge of the Government processes, including policy development, financial planning, performance management systems and basic theories, principles and methods of analysis;
  • Knowledge of computerized systems and software, with an emphasis on the MS Office suite and projects.

Minimum Required Education and Experience

  • Bachelor’s degree in Urban and Regional Planning/ Sustainable Development/Environmental Management/ Engineering/ Construction Management or an equivalent discipline or competencies;
  • Two (2) years’ experience in Urban and Regional Planning, Sustainable Development, or related area in the private or public sector, in a highly complex operation.
Salary Scale: $4,266,270 - $5,737,659
