Applications are invited from suitably qualified professionals to resource the role of Lead, Legal Workstream |Enhancing Banking System Competition (EBSC) Programme. The successful candidate will report to the Chair, EBSC Steering Committee (The Senior Deputy Governor), and will be responsible for:

Legal and Technical Guidance

  1. Conducting a detailed review of the existing legislation and regulations locally to determine the extent to which they are appropriate, and if any amendments are required to facilitate eKYC and Account Portability (and any other utility, framework or structure that is being considered by the Bank to enhance competition within the banking sector).  This would include but not be limited to a review of: POCA legislation and regulations, The Terrorism Prevention Act, The Data Protection Act, The Electronic Transactions Act, The Banking Services Act,  BOJ’s Guidance Notes.
  2. Assisting in the development of Concept Papers, if required,
  3. Providing input and support to the Ministry on the draft text of Cabinet Submissions.
  4. Drafting amendments to legislation and regulations, as required.
  5. Assisting in the development of drafting instructions.
  6. Reviewing drafts of Bills and make detailed recommendations for changes.
  7. Providing support, as needed, to facilitate the tabling of the Bills in Parliament 
  8. Drafting codes of conduct and standards of sound practice, as required.

Coordination of Legal Workstream of the EBSC Programme

  1. Working with the EBSC Programme Manager to ensure effective and timely delivery of milestones for the Legal workstream.
  2. Liaising with EBSC Steering Committee members, other members of the EBSC Programme and other Bank officers, and officers in other agencies, as appropriate, with regard to activities associated with the EBSC Programme.
  3. Preparing project reports, presentations and other relevant documentation for the Legal workstream of the EBSC Programme.
  4. Documenting lessons learned arising from the project activities undertaken by the Legal workstream
  5. Performing any other duties consistent with the nature and function of the job. 

QUALIFICATION AND EXPERIENCE

  • Bachelor of Laws and Certificate of Legal Education
  • At least ten (10) years’ experience as an attorney, at least three (3) of which should be in a senior managerial capacity in financial regulatory compliance or legislative drafting.
  • Training or certification in project management would be a distinct asset.

  • Sound knowledge of financial regulation.
  • Sound knowledge of research design and methodologies.
  • Excellent analysis and problem-solving skills.
  • Excellent written and oral communication and presentation skills.
  • Excellent technical report writing skills.
  • Excellent leadership and interpersonal relationship skills.
  • Knowledge of project management principles and techniques.
  • Solutions oriented, systematic, and organized.
